You are free to use Hsoi's App Shell (HAS) in any manner you like in freeware, shareware, or commercial programs, or just as a learning tool or code library, etc., subject to the following conditions:
• I, John C. Daub, retain all rights on the shell and on my original source code and the modifications I made to source not originally authored by me. Code not authored by me is the properly of its respective author, and you are subject to the distribution and licensing rights set forth by that author should you use their code (e.g. if you use WASTE, you are subject to Marco Piovanelli's distribution and licensing conditions. If you do not use WASTE, you would not be subject to Marco's conditions but you would still be subject to mine).
• You expressly acknowledge and agree that use of this software is at your sole risk. This software and the related documentation are provided "AS IS" and without warranty of any kind, expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Under no circumstances including negligence, shall I or any other author whose work is included in HAS be held liable for any incidental, special, or consequential damages that result from the use or inability to use the software or related documentation, even if advised of the possibility of such damages.
• You notify me that you are using HAS. HAS is freeware (i.e. there is no fee due to me for using HAS), but I still would like to know who is using HAS. This would allow me to create a database of users for whatever might be suitable: finding beta testers, creating a mailing list, just knowing that I've done something useful, etc. Contacting me is best done via email, but snail mail can also be done (please do not contact me by telephone). When contacting me to register, please include your full contact information (name, snail mail and email addresses, phone number, web page URL if you have one) and as much information about your computer setup as possbile (what compiler you use, what language you use, what other development tools you use, and as much about your computer as possible. An easy way to do this would be to use something like Norton Utilitites's System Info print out or TechTool. This not only allows me to know your system software, extensions and control panels installed, but also hardware configurations and every detail I'd ever want to know. This allows me to know what my users have in terms of configurations and could help in tracking down bugs and problems). If you would also like, a little note now or later about what you are using HAS for, what it has helped you with, what problems you have found, what you might like to see in the future would all also be appreciated.
• You send me a complimentary copy of the finished product, either electronically or by postal mail. This means that I get a full, registered copy. This does not apply to in-house development, but any in-house developments you do make with HAS, I would not mind seeing them, so it is up to you if you wish to send me one.
• Hsoi's App Shell can be freely distributed in electronic form over computer networks so long as the full original package is distributed. Any modified versions of HAS are not allowed to be distributed without prior consent of the author, me. If you do make modifications to HAS and would like them distributed, contact me with and about your modifications and we can see about encorporating them officially into HAS. HAS cannot be distributed by other means, including but not limited to printed form, on magnetic media (such as floppy disks), or on CD-ROM. There can be no fees directly charged or directly associated with the distribution of HAS, such as the "$5 floppy disk" fee. Special permission is granted to the following companies for including Hsoi's App Shell on their CD collections:
Pacific HiTech, Inc.
Info-Mac CD-ROM
Celestin Company
Apprentice
Metrowerks
CodeWarrior
Macintosh Users Groups (MUGs). If a MUG wishes to include HAS on their CD, please contact me first so I can know which MUG is doing so.
If the above listed companies do include HAS on their CD-ROM's, it would be appreciated to receive a complimentary copy of the CD it is included on, but it is not required.
If you wish to distribute HAS in some way or form, please contact me and we can work together to see what we can do.
